Terms of Use

Consumers keep their mandatory rights. If you use this Page as a consumer, nothing here removes or limits the rights granted to you by the law of your country of residence. Where a clause conflicts with a mandatory consumer protection that applies to you, that protection prevails.

1. What the beta is

Avaqia is a gamified app for learning practical AI skills, currently in a testing phase ("beta"). The beta program is free and experimental: the product may contain errors, change how it works, become temporarily unavailable, or be discontinued at any time, without prior notice.

2. Eligibility, application, and selection

To apply, you must be 18 years of age or older. The Page is for adults and is not directed to minors.

Submitting an application does not guarantee a place in the beta. Selection is at our discretion, based on the profile and availability you provide. We reply to every application by email, usually within 3 days. You are responsible for providing accurate information and keeping your contact details up to date.

3. Beta rewards

Any rewards described on the Page (for example, a period of Premium access at launch, a prize for the top of the leaderboard, and a founding-tester badge) are conditional on actually taking part and on following the program rules, including the minimum activity described on the Page. Where a reward takes the form of a prize or competition (such as a leaderboard prize), we will publish its specific rules — eligibility, how the winner is determined, and the prize — before that competition runs, and it is void where prohibited by law. Rewards may be adjusted, replaced with an equivalent, or cancelled if the beta or the launch changes or is discontinued, except where that would take away a reward already earned under published rules.

The "Avaqia" brand, the "Ava" mascot, and the texts, images, and other elements of this Page belong to Avaqia or its licensors. You may not copy, reproduce, or use these elements without prior authorization.

6. Disclaimers and limitation of liability

The Page and the beta are provided "as is" and "as available," without warranties of continuous operation, freedom from errors, or fitness for a particular purpose. To the maximum extent permitted by applicable law, Avaqia is not liable for indirect, incidental, or consequential damages arising from the use or unavailability of the Page or the beta.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under the law that applies to you — including liability for death or personal injury caused by negligence, for fraud, or for your mandatory rights as a consumer.

How we handle your personal data is described in our Privacy Policy, which forms part of these Terms.

8. Changes

We may update these Terms at any time. The version in force is always the one published on this Page, with the update date shown above.

9. Governing law and disputes

These Terms are governed by the law of the country in which Avaqia is established, except that, if you are a consumer, you may also bring proceedings in the courts of your country of residence and you keep the benefit of the mandatory consumer-protection laws there. Mandatory local law that applies to you is not overridden by this clause. (Brazilian users remain governed by the PT-BR Terms and Brazilian law.)
